In North Carolina, the Clerk of Superior Court has exclusive
jurisdiction over the administration of estates of decedents. In fact, in North Carolina unlike
other jurisdictions, the Clerk serves as the Probate Judge. Probate is the process of ensuring
the proper distribution of a decedent’s assets.
The appropriate venue for the probate of a will and the
administration of an estate is in the county where the decedent was
domiciled at the time of his death.
Our Estates Division is designed to assist you in handling your
probate matters, including settlement and administration of a decedent’s
estate, incompetent’s estates, probate of wills, administration of small
estates, spouse’s years allowance; and the appointment of guardians for
minors and incompetents.
